Product, Authenticity & Safety Policy

1. Independent Retailer and Product Categories

Magpie & Junebug is an independent Arizona retailer that purchases and resells merchandise through wholesale and distribution channels. Our inventory may include:

1. Genuine branded or licensed products purchased through legitimate wholesale channels;
2. Unbranded, inspired-by, or "like" items obtained through mixed wholesale lots or other vendors; and
3. Hand-assembled bundles, including scoops, gacha balls, themed mystery boxes, and other novelty or collectible assortments.

Not every product sold by Magpie & Junebug is branded, licensed, or manufactured by a recognized brand owner. Product descriptions and notices on individual product pages control for purposes of identifying the applicable product category and disclosures.

Product availability, packaging, labeling, accessories, colors, designs, and exact contents may vary by product, lot, shipment, or assortment.

2. Genuine Branded and Licensed Products

For products specifically identified on the applicable product page as "Genuine Branded Product," Magpie & Junebug represents that, based on the sourcing information reasonably available to us, the product is an original, genuine product obtained through legitimate wholesale or distribution channels.

Magpie & Junebug is an independent retailer. Unless expressly stated otherwise in writing for a specific transaction, Magpie & Junebug is not affiliated with, authorized by, sponsored by, or endorsed by the applicable trademark owner, copyright owner, character owner, manufacturer, or licensor.

All product names, character names, trademarks, service marks, logos, artwork, and brand names belong to their respective owners. They are used by Magpie & Junebug only to identify and describe products offered for sale.

A product's appearance on this website does not create or imply a sponsorship, partnership, agency relationship, endorsement, or authorization by any brand or intellectual-property owner.

3. Manufacturer Warranties and After-Sale Support

Magpie & Junebug is not the manufacturer of the products we sell. The exception is any product identified on its product page as "Handmade by Magpie & Junebug," which Magpie & Junebug makes itself; for those products, contact Magpie & Junebug rather than a manufacturer. Manufacturer warranties, guarantees, registrations, replacement programs, customer-support programs, and other manufacturer benefits may not apply to products purchased through an independent retailer or outside the manufacturer's authorized sales channel.

Unless expressly stated on the applicable product page or required by law:

• Magpie & Junebug does not provide a separate manufacturer's warranty;
• any manufacturer warranty is governed solely by the manufacturer's terms;
• warranty coverage may depend on the manufacturer, product, seller, country of origin, purchase channel, or proof of purchase; and
• customers should contact the manufacturer directly regarding any manufacturer warranty claim.

Nothing in this policy excludes or limits any warranty or consumer right that cannot lawfully be excluded or limited.

4. Unbranded, Inspired-By, and "Like" Items

Products identified as "unbranded," "inspired-by," "like," "style," "novelty," or "look-alike" are not represented as genuine products of, or authorized by, any brand, character owner, trademark owner, copyright owner, manufacturer, or licensor.

Unless expressly identified as a Genuine Branded Product:

• the item is not an official product of the referenced brand or character;
• the item is not licensed, sponsored, endorsed, or approved by that brand or character owner;
• Magpie & Junebug does not represent that the item was manufactured by the referenced brand owner;
• any comparison or descriptive reference is for identification or style-description purposes only; and
• no customer should rely on a brand or character reference as evidence of authenticity, affiliation, licensing, or endorsement.

Magpie & Junebug does not intentionally offer counterfeit, stolen, or unauthorized goods. We may remove, suspend, or refuse to sell any item if we cannot reasonably verify its source, authenticity, safety, legal status, or compliance with applicable platform or marketplace rules.

A disclaimer does not authorize the use of another party's trademarks, copyrighted artwork, trade dress, character designs, or other intellectual property. We reserve the right to revise or remove listings that may create confusion or raise intellectual-property concerns.

5. Adult Purchaser and Collectible Notice

Magpie & Junebug sells novelty, collectible, gift, and lifestyle merchandise to adult purchasers. Unless a product page expressly states otherwise, you must be at least 18 years old to purchase products from this website.

By placing an order, you represent that:

• you are at least 18 years old;
• you are purchasing for yourself or with the authorization of an adult purchaser;
• you will use the product only for its intended purpose;
• you will follow all manufacturer instructions, age guidance, warnings, and care instructions; and
• you will keep products away from children when the product, packaging, listing, or warning indicates that it is not intended for children.

Products marketed as adult collectibles are intended for display, collection, novelty, or adult gift purposes. Adult-collector marketing or an 18+ purchase requirement does not replace legally required safety standards, testing, certification, tracking labels, packaging, instructions, or warnings. It also does not by itself determine whether a product is legally classified as a children's product.

Parents, guardians, caregivers, and purchasers are responsible for determining whether a product is appropriate for a particular individual and for supervising any foreseeable use. Children must not use adult collectibles or products marked "not for children" or "not a toy."

6. Small Parts and Choking-Hazard Notice

Some products sold by Magpie & Junebug may contain small parts, detachable components, beads, charms, balls, marbles, magnets, cords, or other items that may present a choking, ingestion, entanglement, or other safety hazard.

These warnings are product-specific and may vary depending on the product, packaging, manufacturer information, and applicable law. Customers must read and follow all warnings appearing on the product, packaging, instructions, and applicable product page.

A general website warning does not replace any product-specific warning required by law. If a product page, package, or manufacturer warning conflicts with a general notice, customers should follow the more specific warning and contact Magpie & Junebug before use if clarification is needed.

7. General Product-Safety Notice

Customers must inspect products before use and must not use any product that appears damaged, broken, defective, incomplete, contaminated, or unsafe.

Do not:

• modify, alter, disassemble, or misuse a product;
• use a product for a purpose not recommended by the manufacturer;
• allow children to use a product marked for adults or containing small parts;
• place small products or components near infants or young children;
• use products near food, heat, water, or animals unless the product is specifically designed for that use;
• remove required safety labels, warnings, or tracking information; or
• combine products with other items in a way that creates a foreseeable safety risk.

Product packaging, instructions, age recommendations, safety warnings, and manufacturer information should be retained whenever practicable.

Product information on this website is based on information reasonably available to Magpie & Junebug and may be incomplete for products obtained through mixed wholesale lots. If required safety information, manufacturer information, or labeling is missing or unclear, customers should contact Magpie & Junebug before purchasing or using the product.

8. Children's Products and Compliance Information

A product's legal classification depends on the product's design, intended use, packaging, labeling, marketing, advertising, consumer perception, and other applicable factors. An 18+ purchasing restriction or adult-collector notice does not automatically prevent a product from being treated as a children's product under applicable law.

Magpie & Junebug does not represent that a general disclaimer, age notice, or product description replaces any required:

• Children's Product Certificate;
• General Certificate of Conformity;
• third-party testing;
• tracking label;
• small-parts or choking-hazard warning;
• lead, phthalate, flammability, toy-safety, or other compliance requirement;
• manufacturer or importer information;
• safety instruction;
• registration card; or
• recall or reporting obligation.

Where applicable, Magpie & Junebug may request or review supplier invoices, product documentation, test reports, certificates, tracking-label information, manufacturer information, and safety warnings before listing or shipping a product.

If a product is subject to a recall, safety notice, suspected defect, or other compliance concern, Magpie & Junebug may suspend sales, remove the product listing, contact affected customers, cooperate with regulators, or take other corrective action.

9. Products Purchased Through Mixed Wholesale Lots

Some products may be purchased in assorted or mixed wholesale lots in which the exact contents are not known before the shipment is opened. In those circumstances:

• individual products may vary in brand, design, packaging, manufacturer, country of origin, and labeling;
• Magpie & Junebug may not receive a separate invoice for each individual item;
• product documentation may not be available for every item at the time of purchase;
• a product may be removed from sale if its source, authenticity, safety, or compliance cannot be reasonably verified; and
• the product page or bundle description will provide the information reasonably available to Magpie & Junebug.

Customers should not assume that an item selected from a mixed wholesale lot is genuine, licensed, authorized, or affiliated with a particular brand unless the product is expressly identified as a Genuine Branded Product.

10. Scoops, Gacha Balls, and Mystery Boxes

Magpie & Junebug may offer hand-assembled scoops, gacha balls, themed mystery boxes, and other assortments containing mixed products.

Unless a product page expressly states otherwise:

• contents are selected at random or according to the stated assortment process;
• a minimum or guaranteed item count will be stated in the applicable listing;
• no specific brand, character, color, style, value, or individual item is guaranteed;
• duplicate, similar, substitute, or varied items may be included;
• photographs may show examples and may not depict the exact contents shipped;
• the contents may include genuine branded products, unbranded novelty items, or both, depending on the listing;
• the contents may vary between units of the same product;
• the bundle may include small parts or components; and
• the bundle is intended for adult purchasers and adult novelty or collectible use unless the product page expressly states otherwise.

Gacha balls are an exception to the list above in one respect: each gacha ball contains a premium item that sells in our shop for at least the price of that gacha ball, as stated on the gacha ball's product page. This does not guarantee a particular item, brand, character, or color.

Apart from that gacha ball statement, a guaranteed item count does not guarantee a particular item, brand, retail value, or combination of items. The stated guarantee applies only to the specific quantity or characteristics expressly described on the product page.

For any bundle containing an item with a specific safety warning, the warning applies to the item even if the item is included in a larger assortment. Customers must inspect all contents before use and keep potentially hazardous items away from children.

11. Special-Order and Distributor Products

Some products may be ordered from a wholesale distributor or other supplier only after a customer places an order. Special-order products may have different packaging, availability, fulfillment times, manufacturer information, warranty terms, or return restrictions.

For special-order products:

• the product page will provide the material information reasonably available before purchase;
• estimated fulfillment dates are estimates and may change;
• the item ships from Magpie & Junebug;
• the manufacturer's packaging and instructions may control product use and warnings; and
• cancellation, return, replacement, and refund rights are subject to the applicable product page, order terms, and law.

Magpie & Junebug may maintain supplier invoices and compliance records internally without publicly identifying its distributors or wholesale vendors.

12. Product Descriptions, Images, and Availability

We make reasonable efforts to provide accurate descriptions, photographs, measurements, colors, materials, brand information, and safety information. However:

• colors may appear differently on different screens;
• handmade, assorted, or small-batch products may vary;
• packaging may change without notice;
• manufacturer information may be updated after a listing is created;
• photographs may include display items, props, or examples that are not included;
• an image of a bundle does not guarantee the exact items shown; and
• availability may change before an order is confirmed.

If a product description contains a material error, Magpie & Junebug may contact the customer before fulfillment, offer an alternative, cancel the order, or issue a refund as permitted by law and the applicable order terms.

14. Limitation of Liability

To the fullest extent permitted by law, Magpie & Junebug will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of enjoyment arising from or related to a product, purchase, shipment, delay, misuse, modification, or inability to use a product.

To the fullest extent permitted by law, Magpie & Junebug's total liability relating to a particular product or order will not exceed the amount actually paid to Magpie & Junebug for that product or order.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability arising from fraud, willful misconduct, or other matters for which limitation is prohibited by applicable law.

Nothing in this Section 14 limits or replaces our Returns & Refunds policy or our Damaged Items policy. Those policies apply as written.

15. Defects, Injuries, and Safety Concerns

Customers should promptly contact Magpie & Junebug at magpieandjune@gmail.com regarding any suspected defect, injury, choking incident, near miss, missing warning, unsafe condition, or product concern.

Please include, if available:

• order number;
• product name;
• date purchased;
• photographs or video;
• description of the condition or incident;
• lot, batch, tracking, or manufacturer information; and
• whether medical treatment was sought.

Customers should immediately stop using a product that may be defective or unsafe and should preserve the product, packaging, warnings, and instructions when reasonably possible.

Magpie & Junebug may investigate, request additional information, issue a refund or replacement, remove a product from sale, notify suppliers or manufacturers, and report information to governmental authorities when required by law.

16. Intellectual Property and Brand References

All trademarks, service marks, logos, character names, artwork, product names, photographs, and other intellectual-property rights belong to their respective owners.

Nothing on this website grants a customer or third party a license to use Magpie & Junebug's content or any third party's intellectual property.

Product references are intended to identify and describe products offered for sale. Magpie & Junebug does not claim ownership of third-party brands and does not represent an affiliation, endorsement, sponsorship, authorization, or licensing relationship unless expressly stated in writing for the particular product or promotion.

17. Policy Changes

Magpie & Junebug may update this policy from time to time to reflect changes in products, suppliers, safety information, platform requirements, business practices, or applicable law. The version displayed on this website at the time of purchase will apply to that purchase, except where a later change is required by law.
